The legal foundation for the SAFE Regulation is Article 122 of the Treaty on the Functioning of the EU (TFEU) , which empowers the Council to adopt measures providing financial assistance to Member States in the face of severe difficulties caused by exceptional events. SAFE is explicitly framed as an Article 122 instrument – an emergency, solidarity-based response to the unprecedented deterioration of Europe’s security environment. Because it relies on this treaty basis, the Regulation is by nature temporary and crisis-driven , enacted in light of Russia’s aggression and its disruptive impact on defence capabilities and public finances. Policy-wise, SAFE forms a central pillar of the European Commission’s ReArm Europe Plan , a five-pronged strategy unveiled in March 2025 to massively ramp up defence investment. The ReArm Europe framework envisions unlocking up to €800 billion for defence; the SAFE instrument specifically contributes by mobilising up to €150 billion via EU-backed loans to support and accelerate national military procurement efforts. Together with parallel initiatives (such as joint procurement task forces and investment incentives), SAFE is part of a coordinated push to rebuild European defence, ensure support for Ukraine, and foster a resilient and competitive defence industry across the Union. The SAFE Regulation defines a clear purpose and scope for this new instrument.
