Section 1 – Regulatory scope and legal basis. EDIP creates the Structure for European Armament Programme (SEAP) as a legal vehicle to aggregate demand and ensure timely availability and supply of defence products across their lifecycle, while stimulating cross-border industrial cooperation (Article 40).
It is established by Commission implementing act following a formal application (Article 42) and acquires legal personality only when that act takes effect (Article 43). Binding establishment requirements include a minimum of three members, at least two of which must be Member States (Article 41), and a statutory seat located in a Member State (Article 43).
