Section 1 – Regulatory scope and legal basis. The Regulation establishes a European Military Sales Mechanism to strengthen the competitiveness of the EDTIB and, where relevant, the Ukrainian DTIB, with an explicit operational intent to increase the ability to ensure availability of defence products in time and in volume (Article 36(1)).

The mechanism is legally defined as a three-part construct: a European Military Sales Catalogue, the possibility of establishing, managing and maintaining defence industrial readiness pools, and measures contributing to facilitation of procedures for the common procurement of defence products (Article 36(2)).
