Regulatory scope and legal basis. Emergency defence innovation actions are a crisis-only instrument that becomes available exclusively when the Council activates the security-related supply-crisis state by implementing act adopted by qualified majority on a Commission proposal.
The implementing act must specify the duration of that state, which initially must not exceed 12 months, and must specify which measures set out in Articles 65 to 71 are activated, with the possibility to identify the crisis-relevant defence products covered. Upon expiry, prolongation expiry, or early termination, the measures taken in accordance with Articles 65 to 71 must immediately cease to apply.
